1 - Interpretation and Definitions

1.1 - Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or in the plural.

1.2 - Definitions

For the purposes of these Terms of Service:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for the election of directors or other managing authority.
  • Application means the software program provided by the Company or Operator downloaded by You on any electronic device, named Countryside Classifieds.
  • Buyer refers to users of the Service who are placing Orders for Goods.
  • Country refers to the United Kingdom (UK).
  • Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Countryside Classifieds, * Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Countryside Classifieds, Suite A, 82 James Carter Road, Mildenhall.   • Content refers to content such as text, images, or other information that can be posted, uploaded, linked to, or otherwise made available by You, regardless of the form of that content.
  • Device means any device that can access the Service such as a computer, a cell phone, or a digital tablet.
  • Feedback means feedback, innovations, or suggestions sent by You regarding the attributes, performance, or features of our Service.
  • Good refers to the items or services offered for sale, rental, auction, contact, or any other means of trading on the Service.
  • Operator (referred to as either "the Operator", "We", "Us" or "Our" in this Agreement) refers to Countryside Classifieds Ltd.
  • Order means a request by You to purchase or trade by any means Goods on the Application or Website.
  • Seller refers to users of the Service who are listing Goods and making them available for trade by any means.
  • Service refers to the Application or the Website or both.
  • Terms of Service (also referred to as "Terms") mean these Terms of Service that form the entire agreement between You and the Company or Operator regarding the use of the Service. This Terms of Service agreement was generated by TermsFeed and fine-tuned by Sharetribe.
  • Third-party Social Media Service means any services or content (including data, information, products, or services) provided by a third party that may be displayed, included, or made available by the Service.
  • Website refers to Countryside Classifieds Ltd, accessible from www.countrysideclassifieds.co.uk.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

3 - Acknowledgment

These are the Terms of Service governing the use of this Service and the agreement that operates between You and the Company or Operator. These Terms of Service set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms of Service. These Terms of Service apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms of Service. If You disagree with any part of these Terms of Service then You may not access the Service.

You represent that you are over the age of majority according to the laws of your country or the Country, whichever is higher. The Company or Operator does not permit those under that age to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company or Operator. Our Privacy Policy describes Our policies and procedures on the collection, use, and disclosure of Your personal information when You use the Application or Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

4 - Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern these Terms and Your use of the Service. Your use of the Application or Website may also be subject to other local, state, national, or international laws.

4.1 - For United Kingdom (UK) Users

The Service operates in the United Kingdom and is subject to all applicable UK laws and regulations governing online businesses, marketplaces, and e-commerce. Users are responsible for ensuring that their activities comply with any additional laws applicable to their location or business operations. Countryside Classifieds does not provide legal advice and assumes no liability for non-compliance by users.

4.2 - Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force, and effect.

4.3 - Waiver

Except as provided herein, the failure to exercise a right or to require the performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.

5 - User Accounts

5.1 - Account Creation

When You create an account with Us, You must provide Us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of Your account on Our Service.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than You without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

5.2 - Account Information

You may be asked to supply certain information relevant to Your Account including, without limitation, Your name, Your email, Your phone number, and Your address.

You may have to provide documents to comply with identity verification.

Before or during posting Goods, you may be asked to supply, without limitation, Your bank account details, and Your identity documents.

Before or during placing an Order, you may be asked to supply, without limitation, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

5.3 - Account Review

Unless part of a feature of the Service, We do not perform background checks or endorse any users. We do not accept any responsibility for the reliability, accuracy, and completeness of any information provided by users.

5.4 - Account Password

You are responsible for safeguarding the password that You use to access the Service and for any activities or actions under Your password, whether Your password is with Our Service or a Third-Party Social Media Service.

You agree not to disclose Your password to any third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.

5.5 - Account Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms of Service. Upon termination, Your right to use the Service will cease immediately.

If You wish to terminate Your Account, You may simply discontinue using the Service or delete Your Account from the Service, or contact Us for help.

6 - Content

6.1 - Your Right to Post Content

Our Service allows You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post, or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.

You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

6.2 - Content Restrictions

The Company or Company or Operator is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

  • Unlawful or promoting unlawful activity.
  • Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.
  • Spam, machine, or randomly–generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.
  • Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.
  • Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity, or other rights.
  • Impersonating any person or entity including the Company or Operator and its employees or representatives.
  • Violating the privacy of any third person.
  • False information and features.

6.3 Countryside-Specific Listing Restriction

All items listed on the Service must meet the following criteria:

  • The item is used, produced, made, grown, or procured in the countryside

  • Examples include livestock, crops, farm machinery, handmade rural crafts, preserves, or country-produced goods

Listings that do not comply with this requirement may be removed by Countryside Classifieds at any time, without notice, warning, or explanation. Countryside Classifieds reserves the right to determine compliance in its sole discretion.

6.4 Restricted and Prohibited Goods

Certain items are prohibited and may not be listed or sold on the Service. These include, but are not limited to:

  • Firearms, shotguns, air rifles, and ammunition
  • Explosives, fireworks, or any form of weapon
  • Knives, bladed articles, or combat-style equipment
  • Dangerous, offensive, or illegal items under UK law

Certain items are restricted and may only be listed if compliant with applicable laws, safety standards, and marketplace rules. These include, but are not limited to:

  • Agricultural chemicals (pesticides, herbicides, fertilisers)
  • Fuel, oils, and lubricants
  • Heavy machinery, vehicles, and powered equipment
  • Veterinary supplies and animal medicines (where legally permitted)
  • Animal feeds, supplements, and minerals
  • Electrical equipment and tools requiring safe use

It is the legal responsibility of both buyers and sellers to ensure compliance with all relevant laws for restricted and prohibited goods. Countryside Classifieds reserves the right to remove or suspend any listing deemed prohibited or restricted without notice, warning, or explanation.

The Company or Operator reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company or Operator further reserves the right to make formatting and edits and change the manner of any Content. The Company or Operator can also limit or revoke the use of the Service if You post such objectionable Content. As the Company or Operator cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect, or objectionable, and You agree that under no circumstances will the Company or Operator be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

6.5 - Content Backups

Although regular backups of Content are performed, the Company or Operator does not guarantee there will be no loss or corruption of data.

Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Company or Operator will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company or Operator has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

6.6 - Intellectual Property of Others, Image Ownership, and Copyright Infringement

We respect the intellectual property and copyrights of others. You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing Your copyright. It is Our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property rights of any person. We are ready to comply with applicable local regulations in this matter (including, for example, the Digital Millennium Copyright Act (DMCA), the UK Copyright, Designs and Patents Act 1988, the EU Copyright Directive, and relevant provisions of the UK GDPR and Data Protection Act 2018). User Image Ownership and Permissions When uploading photographs, graphics, or other images (“Images”) to the Service, You agree and confirm that: You either own the Images or hold all necessary rights, licences, and permissions to upload and use them.

The Images do not infringe any copyright, trademark, design right, database right, privacy right, or other intellectual property rights of any third party.

Any identifiable individuals featured in Your Images have given all legally required permissions or consents for their appearance and for the uses described in these Terms.

Images used to represent goods or services are accurate, up-to-date, and depict the actual item or service offered unless clearly labelled as a “stock image for illustration only.”

You must not manipulate Images in a way that materially misrepresents the condition, features, or quality of the goods or services being offered.

By uploading Images to the Service, You grant Us a worldwide, non-exclusive, royalty-free licence (with the right to sublicense) to host, store, reproduce, modify, adapt, publicly display, and distribute such Images for purposes connected with operating, improving, or promoting the Service. This licence continues for as long as the Images remain on the Service or in any promotional materials created while the Images were active. We reserve the right to remove, disable, or request evidence of ownership for any Image that appears to breach these Terms or infringes third-party rights. You agree to indemnify Us against any claims, losses, or liabilities arising from Your Images, including claims relating to copyright infringement, privacy violations, or misuse of personal data. Submitting a Copyright or IP Notice If You are a copyright owner or are authorized to act on behalf of one, and You believe that a copyrighted work has been used in a manner that constitutes infringement through the Service, You must submit Your notice in writing to our copyright agent via email (see 3 – Contact Us) and include in Your notice the following information: An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

A description of the copyrighted work that You claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.

Identification of the URL or other specific location on the Service where the material that You claim is infringing is located.

Your address, telephone number, and email address.

A statement by You that You have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

A statement by You, made under penalty of perjury, that the above information in Your notice is accurate and that You are the copyright owner or authorized to act on the copyright owner's behalf.

Upon receipt of a notification, the Company or Operator will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Service.

7 - Orders of Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

7.1 - Position of the Service in Orders

Our role is one of a facilitator between You and the Sellers, using the Service. We are, therefore, a third party in Orders, which limits Our liabilities in any disputes between You and the Sellers.

We are not a party to any agreement You have with the Sellers. Any agreement You enter with the Sellers does not form a part of any agreement We have with you.

7.2 - Your Information as Buyer

If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct, and complete.

By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

7.3 - Availability, Errors, and Inaccuracies

We and Sellers are constantly updating Our offerings of Goods on the Service. The Goods available on the Service may be mispriced, described inaccurately, or unavailable, and Sellers and We may experience delays in updating information regarding the Goods on the Service and in Our advertising on other websites.

We and Sellers cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

7.4 - Prices Policy

The Company or Operator and Seller reserve the right to revise their prices at any time prior to accepting an Order.

The prices quoted may be revised by the Company or Operator subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs, and any other matter beyond the control of the Company or Operator or the Seller. In that event, You will have the right to cancel Your Order.

7.5 - Payments

Payment can be made through Stripe payment method. We rely on payment gateways that have their own terms of service and their own limitations.

Payment cards (credit cards or debit cards) are subject to validation checks and authorisation by Your card issuer. If we do not receive the required authorisation, We will not be liable for any delay or non-delivery of Your Order.

7.6 - Service Fees

We may charge You some fees (and applicable Taxes) for the right to use the Service. More information about when service fees apply and how they are calculated is displayed during your Order. We reserve the right to change the service fees at any time. Creating a listing on the Service is free of charge. Fees apply only if the payment platform provided on the website is used to process payment for a listing. In that case, a service fee of 6% or a minimum of £0.90, whichever is higher, will apply. Sales completed outside the Platform are not subject to platform fees, but such payments are not covered by Buyer Protection, the refund process, or dispute resolution procedures. Payments processed through the Platform are subject to a 6% commission (minimum £0.90), which enables a secure payment system where funds are held until the buyer confirms receipt.

7.7 - Order Modification

You and the Sellers are responsible for any Order modifications you agree to make via the Service and agree to pay any additional amounts, fees, or taxes associated with any Order modification.

7.8 - Order Cancellation

7.8.1 - Our Order Cancellation Rights

We reserve the right to refuse or cancel Your Order at any time for certain reasons including but not limited to:

  • Goods availability
  • Errors in the description or prices for Goods
  • Errors in Your Order
  • Mistakes from the Seller

We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction or trade is suspected.

7.8.2 - Order Cancellation by Buyers

If You as a Buyer cancel an Order, the amount You paid (including the Service fees) is not refunded.

If something outside Your control requires You to cancel an Order, or if You think your Order should be refunded, contact Us.

7.8.3 - Order Cancellation by Sellers

If You as a Seller cancel an Order, the amount the Buyer paid (including the Service fees) will be refunded to the Buyer and will not be transferred to the Seller.

If something outside Your control requires You to cancel an Order, or if You think your Order should be refunded, contact Us.

7.9 - Order Dispute

If a Buyer or a Seller disputes an Order, the Company or Operator should be notified. The dispute will be resolved at Our sole discretion.

7.10 Seller Responsibility for Shipment and Delivery

7.10.1 Shipment and Insurance Obligations

Sellers are solely responsible for ensuring that all Goods listed on the Service are dispatched using an appropriate and verifiable method of transport, whether by post, courier, pallet, haulier, livestock transporter, or any other delivery service suitable to the nature of the item. All shipments must include valid tracking information or equivalent proof of delivery. Sellers must also ensure that all Goods are covered by adequate insurance or equivalent protection to safeguard against loss, damage, or delay during transit. It is the sole responsibility of the Seller to include any necessary costs for insurance within the postage or delivery charges.

7.10.2 Livestock/animals and Special Goods

In the case of livestock/animals or any perishable or sensitive Goods, Sellers are responsible for compliance with all applicable welfare, transport, and safety regulations. The Seller retains responsibility for the care, welfare, and security of such Goods until they are delivered to and accepted by the Buyer.

7.10.3 Transaction and Shipping Timelines

Sellers have 14 days from the date of purchase to mark an item as shipped. Failure to do so will result in automatic cancellation of the transaction. Once an item is marked as shipped, a new 14-day period commences, during which the transaction will automatically complete unless the Buyer raises a dispute. During this second 14-day period, the Buyer may dispute the transaction at any time prior to marking the item as received.

7.10.4 Delivery Responsibility

All deliveries arranged and executed by the Seller, including those sent via pallet, haulier, or livestock transporter, remain the responsibility of the Seller until the Goods are received and accepted by the Buyer. Countryside Classifieds Ltd and The Buyer accepts no liability for loss, damage, or delay of Goods during transit where the Seller arranges delivery independently.

7.10.5 Buyer Protection and Dispute Resolution

Buyer Protection, including the right to raise disputes through the Service, is only available for transactions in which payment is processed through the website. Transactions completed externally, or payments made outside of the Service, are not eligible for Buyer Protection or dispute resolution.

7.10.5 Buyer-Arranged Collection or Transport

Where the Buyer arranges or appoints their own carrier, haulier, agent, or representative to collect or transport the Goods (including livestock/animals or other perishable items), responsibility and risk for the Goods shall transfer to the Buyer at the point the Goods are handed over to the Buyer’s nominated carrier or representative, or at the time and place mutually agreed for collection. From that moment, the Buyer assumes full responsibility for the care, welfare, security, and transport of the Goods, and the Seller shall bear no liability for any loss, damage, injury, deterioration, or delay occurring thereafter. The Buyer is responsible for ensuring that any carrier or transporter they engage complies with all applicable animal welfare, transport, safety, and legal regulations. The Seller shall provide reasonable cooperation and documentation necessary to facilitate collection but shall not be required to insure or supervise the Goods once handover has occurred.

7.11 - Refund Policy

Effective Date: 8th November 2025

7.11.1. General Principles

This Refund Policy applies to all transactions conducted through Countryside Classifieds Ltd (“the Platform”). Refunds will only be issued in accordance with this policy and in compliance with UK consumer protection law. Countryside Classifieds Ltd operates as a facilitator of transactions between independent buyers and sellers. It does not act as the seller of goods listed on the Platform unless expressly stated otherwise. Only transactions completed through the Platform’s secure payment system (Stripe) are eligible for buyer protection and covered under this policy. Refunds will be returned to the original payment method used for the purchase.

7.11.2. Eligibility for Refunds

The item has not been sent within the specified dispatch timeframe.

The item, Animal, or Livestock is materially different from its description or advertised condition and proof or evidence of such is available.

The item arrives damaged, defective, unfit for purpose, or unfit for travel.

Livestock or Animals are found, upon verified evidence, to have been unfit for transport, unwell, or misrepresented at the time of handover (see clause 7.11.5).

Refunds are not available in cases of: Buyer’s remorse, change of mind, or post-sale dissatisfaction unrelated to misdescription.

Deterioration, death, or damage occurring after handover unless clear evidence proves a pre-existing defect or breach by the Seller (see clause 7.11.5).

Transactions or payments completed outside the Platform’s payment system.

Partial refunds are not supported and will only be considered in exceptional circumstances at the sole discretion of Countryside Classifieds Ltd.

7.11.3. Timeframes and Disputes

Sellers have 14 days from the date of purchase to dispatch an order. Once an item has been dispatched, buyers have 14 days from the dispatch date to raise a dispute if they are dissatisfied with their order. Disputes must be raised via the buyer’s Order Page using the “Raise a Dispute” function. If no dispute is raised within the 14-day period, the transaction will automatically be marked as complete, and the seller payout will be released. Once a transaction is marked as received, refunds can no longer be processed through the Platform. If an order is not dispatched within 14 days of purchase, the order will be automatically refunded in full.

7.11.4. Lost or Undelivered Parcels

Where a parcel is confirmed lost in transit, the seller is responsible for seeking compensation directly from the courier. In such cases, the buyer will receive a full refund through the Platform’s payment system.

7.11.5 Post-Delivery Deterioration or Loss

Where Goods, livestock, animals or other items arrive in acceptable condition but subsequently fail, deteriorate, or die within seven (7) days of delivery or collection, the following shall apply: Livestock: Refunds or replacements will only be considered where there is verifiable evidence that the illness, injury, or death resulted from a pre-existing condition, misrepresentation, or breach of welfare or transport obligations by the Seller. Natural causes, stress, injury, or improper aftercare following handover shall not qualify for a refund.

Goods or Equipment (including second-hand items): Refunds may be issued where it can be demonstrated that a material fault existed at the time of delivery or collection, in accordance with the Consumer Rights Act 2015. For second-hand items, satisfactory quality and condition are assessed reasonably, taking into account the item’s age, description, price, and disclosed or visible wear. No refund shall be due where defects were clearly described, visible at the time of sale, or consistent with reasonable use and age.

Buyers must notify the Seller and Countryside Classifieds Ltd in writing within seven (7) days of receipt, providing appropriate evidence (e.g. photographs, veterinary reports, or inspection records).

Countryside Classifieds Ltd reserves the right to request additional documentation or expert verification before determining eligibility for a refund or partial refund.

Where no evidence of defect or pre-existing issue is found, no refund shall be due, and risk remains with the Buyer from the point of delivery or agreed handover.

7.11.5.1 Burden of Proof

In accordance with the Consumer Rights Act 2015, responsibility for proving whether a defect or fault existed at the time of delivery or collection shall be determined as follows: The Buyer must demonstrate that the Goods, livestock, or animals were not as described, not of satisfactory quality, or not fit for purpose at the time of delivery or handover.

7.11.5.2 Marketplace Refund and Dispute Window

Buyers must raise any disputes or refund claims within fourteen (14) days of delivery or collection of the Goods. For livestock and live animals, any issues relating to health, welfare, condition, or fitness must be reported within seven (7) days of delivery or collection. If no dispute is raised within the applicable period, the transaction will automatically be marked as complete, and the payout to the Seller will be triggered. After this point, Countryside Classifieds Ltd shall have no further obligation to facilitate refunds or dispute resolution, and any subsequent claims shall be made directly between the Buyer and Seller. This limitation applies solely to the Platform’s internal dispute and refund process and does not affect the Buyer’s statutory rights against the Seller under the Consumer Rights Act 2015.

7.11.5.3 Goods Sold as Seen

All Goods, animals, and livestock listed through the Service are sold ‘as seen’ and ‘as described’ by the Seller. Countryside Classifieds Ltd makes no warranties, express or implied, regarding condition, quality, or fitness for purpose. Sellers are responsible for ensuring that listings accurately describe the Goods. Buyers are solely responsible for verifying the suitability, quality, and condition of Goods prior to purchase or collection. This clause does not exclude or limit liability for misrepresentation, fraudulent description, or where exclusion would contravene applicable UK consumer law.

7.11.6. Payments Covered by This Policy

This Refund Policy applies only to payments processed through the Countryside Classifieds Ltd website using Stripe. Transactions conducted or paid for outside the Platform are not covered by Countryside Classifieds Ltd’s buyer protection, refund process, or dispute resolution procedures. Countryside Classifieds Ltd accepts no liability for such transactions.

7.11.7. Refund and Dispute Resolution Process

Refunds can only be initiated by Countryside Classifieds Ltd following a verified dispute. All refund decisions are made based on the evidence provided by both buyer and seller. Once approved, refunds will be processed through Stripe and issued to the original payment method. If a dispute is resolved in favour of the seller, the funds will be released accordingly.

7.11.8. Fraud, Abuse, and Misuse

Countryside Classifieds Ltd reserves the right to withhold, delay, or refuse refunds where fraudulent, abusive, or suspicious activity is suspected, or where sufficient evidence is not provided by the buyer.

7.11.9. Legal Compliance

This Refund Policy is designed to comply with all applicable UK laws and regulations, including:

  • Consumer Rights Act 2015
  • Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
  • Payment Services Regulations 2017

Nothing in this policy limits or excludes any statutory rights available to consumers under UK law.

7.11.10 Resolution in Favour of Buyer

Where Countryside Classifieds Ltd determines, based on clear and verifiable evidence, that Goods, Animals, or Livestock were not accurately described, misrepresented, or unfit for purpose or travel at the time of sale or collection, the dispute will be resolved in favour of the Buyer. Acceptable forms of evidence include, but are not limited to: Photographs or videos showing clear misdescription or undisclosed defects.

Veterinary reports or professional assessments verifying pre-existing illness or unfitness.

Communications or listings proving inaccurate or misleading claims.

In such cases, Countryside Classifieds Ltd may, at its sole discretion: Issue a full or partial refund to the Buyer;

Require the Seller to arrange and fund the return, replacement, or other appropriate resolution; or

Take disciplinary action against the Seller, including account suspension or permanent removal.

When a dispute isn't resolved after 60 days, the system automatically cancels the transaction and issues a full refund to the customer, including marketplace commission. Countryside Classifieds Ltd’s decision shall be final and binding, based solely on the evidence provided through the Platform. No external or extended appeals process will apply.

7.11.11 Hire and Loan of Goods, Equipment, or Livestock

7.11.1 General Countryside Classifieds Ltd (“the Platform”) provides a venue through which independent users may offer or arrange the hire, loan, or temporary use of goods, equipment, vehicles, or livestock (“Hire Items”). The Platform does not act as a party to any hire, loan, or service agreement. All hire or loan arrangements are strictly between the Lender and the Hirer. Countryside Classifieds Ltd accepts no responsibility or liability arising from such arrangements, including but not limited to loss, damage, injury, or non-performance. 7.11.2 Responsibility and Risk From the moment a Hire Item is handed over or collected, all responsibility, risk, and liability for its safe use, condition, maintenance, and operation transfer to the Hirer, unless otherwise agreed in writing between the parties. The Hirer is responsible for ensuring that the Hire Item is used in a safe, lawful, and competent manner and only for its intended purpose. The Hirer must return the Hire Item in the same condition as it was received, fair wear and tear excepted. 7.11.3 Insurance and Liability Both the Lender and the Hirer are required to ensure that adequate insurance is in place for the duration of the hire or loan period, including (as applicable): Public liability and third-party insurance;

Equipment or livestock insurance covering loss, theft, or damage; and

Any specific insurances required by law or by the nature of the Hire Item.

The Platform does not provide or verify insurance coverage for either party. It is the sole responsibility of the parties to confirm that appropriate insurance policies are in force prior to the commencement of hire. Countryside Classifieds Ltd shall not be held liable for any uninsured loss, damage, injury, accident, or claim arising from the hire or loan of any item, livestock, or equipment listed on the Platform. 7.11.4 Competence and Use The Hirer must hold all necessary qualifications, licences, and competencies required to lawfully and safely operate or use the Hire Item. This includes, but is not limited to, driving licences, operator certificates, livestock handling experience, or other relevant training. The Hirer must not permit any unqualified or unauthorised person to operate or handle the Hire Item. The Lender is entitled to request reasonable proof of such qualifications before the hire or loan is agreed. 7.11.5 Damage, Loss, or Injury The Hirer is responsible for any damage, loss, theft, or injury caused to or by the Hire Item during the hire or loan period, except where it can be clearly demonstrated that such damage pre-existed the handover. The Hirer shall indemnify the Lender and Countryside Classifieds Ltd against all claims, liabilities, damages, costs, and expenses arising from misuse, negligence, unsafe operation, or breach of these terms during the hire period. Countryside Classifieds Ltd accepts no responsibility for any loss of use, loss of income, consequential loss, or injury arising out of or in connection with the hire or loan of any goods, livestock, or equipment. 7.11.6 Condition and Inspection Lenders are responsible for ensuring that any Hire Item listed on the Platform is fit for purpose, safe, and in a serviceable condition at the commencement of the hire or loan. Hirers are responsible for inspecting the Hire Item prior to acceptance. By taking possession, the Hirer is deemed to have satisfied themselves as to its condition and suitability for use. All Hire Items are deemed to be provided “as seen” and “as described”, with no warranties expressed or implied by the Platform. 7.11.7 Disputes and Liability Limitation Any disputes regarding condition, damage, or payment between Lender and Hirer shall be resolved directly between those parties. Countryside Classifieds Ltd shall not mediate, arbitrate, or accept liability for such disputes except where expressly stated within the Platform’s dispute policy. To the maximum extent permitted by law, Countryside Classifieds Ltd disclaims all liability for any injury, accident, damage, or financial loss arising out of the hire, loan, or temporary use of goods, livestock, or equipment facilitated through the Platform. 7.12 – Provision of Services 7.12.1 General Countryside Classifieds Ltd (“the Platform”) provides a venue through which independent users may offer or advertise services, including but not limited to animal care, agricultural contracting, machinery operation, training, breeding, transport, and other rural services (“Services”). The Platform acts solely as a facilitator and does not act as an employer, contractor, agent, or principal for any Service Provider or Customer. All service arrangements are strictly between the Service Provider and the Customer. Countryside Classifieds Ltd accepts no responsibility or liability arising from the provision, quality, performance, or outcome of any Service. 7.12.2 Responsibility and Risk All responsibility for the safe, lawful, and competent provision of any Service rests entirely with the Service Provider. The Service Provider is responsible for ensuring that all work, handling of livestock, use of machinery, or provision of advice is conducted in compliance with all applicable laws, welfare standards, and industry regulations. The Customer accepts responsibility for providing a safe and suitable environment or context in which the Service is performed. 7.12.3 Insurance and Qualifications Service Providers must hold and maintain adequate insurance appropriate to the Services offered, which may include: Public liability insurance;

Professional indemnity insurance (for advisory or consultancy work);

Employer’s liability insurance (where applicable); and

Vehicle, livestock, or equipment insurance, if relevant.

Service Providers must also hold all necessary licences, permits, or professional qualifications required by law or best practice for the Services they perform. Countryside Classifieds Ltd does not verify or warrant the insurance status, competence, or qualifications of any Service Provider listed on the Platform. Customers are responsible for verifying the credentials and insurance of any Service Provider before engaging their services. 7.12.4 Service Quality and Outcomes All Services are provided directly by independent third parties. Countryside Classifieds Ltd makes no warranty, guarantee, or representation regarding the standard, suitability, or results of any Service advertised on the Platform. The Platform shall not be liable for any act, omission, negligence, delay, non-performance, or unsatisfactory result on the part of any Service Provider or Customer. 7.12.5 Damage, Injury, or Loss The Service Provider shall be fully responsible for any damage, loss, injury, or expense arising during or as a result of the Services performed, including damage to property, livestock, equipment, or persons. The Customer shall indemnify the Service Provider and Countryside Classifieds Ltd against any losses, claims, or damages arising from unsafe working conditions, misleading instructions, or failure to disclose relevant information about the premises, animals, or equipment involved. Countryside Classifieds Ltd shall not be held liable for any personal injury, property damage, death, financial loss, or consequential damages resulting from the use of or reliance on any Service listed on the Platform. 7.12.6 Payment and Disputes Unless expressly processed through the Platform’s secure payment system, all payments for Services are to be arranged directly between the Service Provider and the Customer. Countryside Classifieds Ltd shall have no involvement in, or liability for, disputes relating to payment, quality, or completion of Services, except where such transactions are completed through the Platform’s secure system and covered under its dispute policy. 7.12.7 Limitation of Liability To the fullest extent permitted by law, Countryside Classifieds Ltd disclaims all liability and responsibility for any act, omission, advice, or service rendered by a Service Provider or third party. Nothing in this clause shall limit or exclude liability for fraud, fraudulent misrepresentation, or any liability which cannot legally be excluded under UK law. 7.13 – Wanted Adverts 7.13.1 General Countryside Classifieds Ltd (“the Platform”) allows users to post advertisements expressing interest in purchasing, hiring, or obtaining specific goods, livestock, or services (“Wanted Adverts”). These adverts are published solely for the purpose of facilitating contact between independent users. Countryside Classifieds Ltd does not act as a seller, buyer, agent, or intermediary in any transaction that may result from a Wanted Advert and accepts no responsibility or liability for any subsequent agreement, arrangement, or exchange that takes place between users. 7.13.2 Accuracy and Legitimacy Users posting Wanted Adverts are responsible for ensuring that their adverts are accurate, lawful, genuine, and not misleading. The Platform does not verify or guarantee the legitimacy of any Wanted Advert or the credentials of any responding party. Users must exercise all appropriate due diligence before entering into any discussions or transactions resulting from a Wanted Advert. 7.13.3 No Guarantee of Availability or Suitability The Platform makes no representation or warranty that any goods, livestock, or services sought through a Wanted Advert will be available, suitable, or meet the user’s requirements. All responses to Wanted Adverts are made at the sole risk of the responding party. Countryside Classifieds Ltd shall not be liable for any loss, damage, injury, or disappointment arising from unfulfilled or unsuitable responses to a Wanted Advert. 7.13.4 Responsibility and Due Diligence Users engaging with a Wanted Advert are responsible for: Verifying the identity and legitimacy of the other party;

Ensuring all goods, livestock, or services offered or accepted are lawful, safe, and compliant with relevant UK regulations; and

Conducting any necessary inspections, checks, or verifications before entering into an agreement or completing a transaction.

The Platform encourages all users to use safe payment methods and to retain written records of all communications and agreements. 7.13.5 Platform Liability Any transactions, exchanges, or agreements resulting from a Wanted Advert are entirely at the users’ own risk. Countryside Classifieds Ltd shall not be liable for any misrepresentation, non-performance, loss, damage, or injury arising directly or indirectly from any Wanted Advert or related transaction. This includes, but is not limited to, claims relating to the condition, legality, welfare, description, or suitability of goods, livestock, or services obtained through such adverts. 7.13.6 Compliance with Law Users must ensure that all goods, livestock, or services sought or obtained via Wanted Adverts comply with all applicable UK laws and regulations, including those governing animal welfare, transport, sale of livestock, and licensing of controlled equipment or substances. Countryside Classifieds Ltd reserves the right to remove any Wanted Advert that it considers unlawful, misleading, or inappropriate at its sole discretion.

Notwithstanding any damages that You might incur, the entire liability of the Company or Operator and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 GBP (or its equivalent in the Service local currency) if You haven't purchased anything through the Service.

Without limiting the foregoing, neither the Company nor Operator nor any of the company's providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content, and materials or products included thereon; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Service; or (iv) that the Service, its servers, the content, or e-mails sent from or on behalf of the Company or Operator are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.
